Frequently asked questions

What should I do if I am arrested?

If you have been arrested, do not lie. Answer all questions about your identification honestly. If your answer to a question may incriminate you, do not answer it. You have the right to remain silent—use it.

I have been charged with a crime. Do I need an attorney?

Even if the crime with which you have been charged is minor, you may need the assistance of a skilled defense attorney. Be sure to select a lawyer who has experience in the courtroom and has successfully defended clients against charges like yours.

Is it OK to talk about my case with my family and friends?

No. You should only discuss your case with your lawyer. You should not, under any circumstances, make any verbal or written statements to anyone unless your attorney advises you to do so. This includes the police. Anything you say may be used against you in court.

A loved one has been arrested. What should I do?

If a loved one is arrested and contacts you for assistance, get as much information as possible about their arrest. Find out with what crime they are being charged, who made the arrest (local or state police, FBI, etc.), and where they are being held. Also find out if bail has been set and if so, for how much.

What is a felony?

A felony is a crime punishable by incarceration for more than one year and the payment of fines. Capital punishment, or the death penalty, is legal in Virginia. As a result, certain felonies such as murder can result in execution.

What is a misdemeanor?

A misdemeanor is a crime punishable by incarceration of up to one year and the payment of fines. There are four classes of misdemeanors in Virginia.
