Traffic Violations

Speeding

Although not usually considered a serious charge, speeding can impact your driving record and cause you to accumulate points against you license. Typically the penalty for this offense results in a fine only. If enough points are accumulated this could result in a suspension of your license. In addition, a conviction could have an impact on your insurance rates and whether a company will continue to provide coverage.

Points are issued by the Department of Motor Vehicles and are not given by the court or judge. The points given for violations can range from three (3) to six (6) per violation. There are ways that points can be avoided depending on the specific circumstances in each case.

There are defenses available depending on the method used to clock your speed, whether pace, radar or LIDAR. In addition, there can be additional defenses depending on the specific circumstances of your case.

If you do not have a defense to the charge there are other ways of handling these cases that allow you to reduce or eliminate points. There may be negotiations with the prosecutor allowing the charge to be amended to a non-moving violation or to an offense under a county code, either of which would eliminate points.
