Weapons Charges

Generally there are two types of misdemeanor weapons charges. The first is carrying a concealed weapon and the second is brandishing or pointing a weapon. Both are class one misdemeanors with maximum penalties of one (1) year in jail and up to a $2500 fine.

Because weapons have the potential for lethal consequences the courts take these offenses very seriously as does the prosecution. The circumstances surrounding each case must be examined carefully. There are defenses to these charges which should be discussed with an attorney who can determine such things as whether an illegal search was employed to detect the weapon, how the weapon was being used in the case of brandishing, among others. You and your attorney can determine which defense may offer you the best chance of a successful outcome in your case.
