Computer Crimes

There are a number of specific computer crimes, both misdemeanor and felony. Commonly, misdemeanor offenses include advertising, distributing, displaying or otherwise soliciting child pornography, as well as soliciting a child for sexual activities. This is by no means a full list of computer-related crimes. The misdemeanor penalty for these crimes is a class one misdemeanor punishable by one (1) year in jail and up to a $2500 fine.

Because many of these types of crimes involve underlying sex offenses, they can carry with them significant stigma if convicted. Prosecution of these crimes can be difficult due to the fact that usually more than one person has access to a personal computer. This requires the prosecution to prove that the particular person charged is the actual person who committed the offense. There can be other considerations as well when defending these cases. Examples are search and seizure issues in obtaining the computer itself. There are many other defenses that must be considered and are too numerous to mention here.
