Felony Offenses

Arson

Arson Arson is a felony punishable by not less than five years up to life in prison and a fine of up to $100,000 if the structure is an occupied dwelling or used for that purpose. If any other structure or thing is burned it is a class four felony punishable by not less than two years up to ten years in prison.

Arson is a difficult crime to prove and usually requires the testimony of experts in various scientific fields. In addition there is physical evidence or the lack thereof that must be considered as well as both lay and expert witnesses.

Arson can be accomplished by fire or any explosive device or substance. Anyone who is involved in the planning, advising or actual commission of the offense can be held responsible. If anyone is injured as a result of the offense additional charges can be brought, such as murder if there is a death.
